DMCA
Fablebabe respects the intellectual property rights of artists, designers, photographers, creators, and other rights holders. We expect our suppliers, partners, and website users to do the same.
If you believe that content appearing on fablebabe.com—including a product design, photograph, illustration, description, or other material—infringes your copyright, please send us a written notice containing the information outlined below.
This policy is intended to address copyright complaints under applicable copyright laws, including the United States Digital Millennium Copyright Act (DMCA) where applicable.
Submitting a Copyright Infringement Notice
Your written notice must include:
- Your full legal name and your physical or electronic signature.
- Identification of the copyrighted work you believe has been infringed. If your complaint covers multiple works, a representative list may be provided.
- The exact URL(s) or a sufficiently detailed description of the specific content or product you believe is infringing so that we can locate it on our site.
- Your mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Please send the completed notice to:
- Attn: Copyright Agent – Fablebabe LLC
- Address: 1500 N Grant St Ste B, Denver, CO 80203, United States
- Email: support@fablebabe.com
- Subject Line: Copyright Infringement Notice – DMCA
Note: Incomplete notices may delay or prevent our ability to investigate your complaint.
What Happens After We Receive a Notice
After receiving a valid copyright complaint, we may:
- Review the identified content and supporting information promptly.
- Contact you if additional information is required.
- Temporarily restrict, disable, or remove access to the disputed content/product.
- Notify the supplier, creator, or partner responsible for providing the content.
- Provide the affected party with a copy of the notice where appropriate.
- Take further administrative or legal action required by applicable law.
Submitting a complaint does not guarantee permanent removal. We assess each notice in good faith, evaluating the provided evidence, applicable laws, and any response from the affected party.
Counter-Notification
If you believe your content or product was removed or restricted by mistake or misidentification, you may submit a written counter-notification containing:
- Your full legal name and your physical or electronic signature.
- Identification of the material that was removed or restricted and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or restricted as a result of mistake or misidentification.
- Your mailing address, telephone number, and email address.
- A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Denver, Colorado if outside the United States), and that you will accept service of process from the person who submitted the original notice.
After receiving a valid counter-notification, we may forward it to the original complainant. Disputed content may be restored in 10–14 business days unless we receive notice that legal proceedings have been filed against the content provider.
Repeat Infringement Policy
Where appropriate and within our reasonable control, Fablebabe reserves the right to terminate relationships with suppliers, partners, or users who repeatedly provide or publish infringing material.
We may also proactively remove products or content if we reasonably believe they violate intellectual property rights, even in the absence of a formal DMCA notice.
False or Misleading Claims
Copyright complaints and counter-notifications are official legal documents. Knowingly submitting false, misleading, or fraudulent claims may result in civil liability, including damages and legal fees under Section 512(f) of the DMCA.
If you are unsure whether material on our website infringes your copyright, we strongly recommend seeking independent legal advice before filing a notice.
Other Intellectual Property Complaints (Trademarks, Patents & Designs)
For non-copyright concerns involving trademarks, registered designs, patents, counterfeit items, or rights of publicity, please email support@fablebabe.com with:
- Your contact details.
- Proof of ownership or legal authority (including registration numbers where applicable).
- The direct URL(s) of the disputed product or content.
- A clear description of the alleged infringement.
We will review the submission and respond as reasonably appropriate.
