Fablebabe offers this website, including all information, products, services and features available through it, subject to your acceptance of these Terms of Service. By visiting our website, creating an account or purchasing from us, you agree to be bound by these Terms of Service and any additional policies referenced in them, including our:

If you do not agree to these Terms, you should not use this website or place an order.

2. Online Store Terms 

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order through our website. You agree that the information you provide when placing an order is accurate, current and complete. This includes your name, email address, billing information, delivery address and personalisation instructions. You must not use our website or products for any unlawful, fraudulent or unauthorised purpose.

3. Products and Services 

Fablebabe offers children’s products that may include:

  • Personalised gifts and keepsakes
  • Blankets and comfort products
  • Nursery décor
  • Name puzzles and activity products
  • Montessori-inspired and early-learning toys
  • Baby and children’s accessories
  • Other selected children’s products

Some products are produced or fulfilled by third-party manufacturing and fulfilment partners. Product availability may change without notice. We may discontinue a product, colour, style or option where reasonably necessary.

4. Product Information 

We aim to describe and display our products as accurately as possible. However, colours may appear differently depending on your screen, lighting conditions and device settings. Because some products are handmade, embroidered, engraved, printed or otherwise personalised, minor variations may occur in:

  • Placement
  • Stitching
  • Wood grain
  • Shape
  • Texture
  • Print alignment
  • Measurements

These natural or production-related variations are not necessarily product defects. Product measurements are approximate unless expressly stated otherwise. Please review the product description, size information, age guidance and care instructions before purchasing.

5. Personalised Products 

Customers are responsible for checking all personalisation information before placing an order, including:

  • Names and spelling
  • Capitalisation
  • Dates
  • Colours
  • Fonts
  • Sizes
  • Icons
  • Styles
  • Other custom instructions

We will produce personalised items using the information submitted with the order. We are not responsible for errors contained in customer-provided personalisation details. Personalisation requests containing unlawful, abusive, discriminatory, infringing or otherwise inappropriate material may be refused. If a request cannot be completed, we will contact you to request an alternative or arrange an appropriate refund. Once production has started, personalised products may not be changed, cancelled or returned for change of mind.

6. Children’s Products and Adult Supervision 

Parents and caregivers are responsible for selecting products appropriate for the child’s age, ability and developmental stage. Any age recommendations shown on our website are general guidance only and do not replace responsible adult supervision. Before use, customers should:

  • Read and retain all supplied instructions
  • Inspect the product and packaging
  • Remove all packaging materials
  • Check for loose, worn or damaged parts
  • Follow applicable care and safety instructions
  • Stop using a product if it becomes damaged

Children should use products under appropriate adult supervision, particularly where a product contains small parts, cords, removable pieces or decorative components. Nursery décor, mobiles, banners and name signs must be installed securely and kept outside a child’s reach unless the product instructions expressly state otherwise. Nothing in this section limits any consumer guarantee or other right that cannot lawfully be excluded.

7. Prices and Currency 

All prices on Fablebabe are listed, displayed, and processed in United States Dollars (USD) unless otherwise expressly stated. Shipping charges ($4.99 USD standard shipping fee) and any applicable taxes will be displayed at checkout before payment is completed. We may update prices from time to time. A price change will not affect an order we have already accepted unless the original price resulted from an obvious listing or technical error. Discount codes cannot be combined unless expressly stated. Promotions may be subject to separate terms, availability periods or product exclusions.

8. Orders and Acceptance 

Submitting an order does not automatically mean that we have accepted it. After an order is placed, you will normally receive an order confirmation email. This confirms that we have received your order but does not guarantee acceptance or fulfilment. We may reasonably refuse or cancel an order where:

  • A product or material is unavailable
  • Payment cannot be authorised
  • Fraud or unauthorised activity is suspected
  • The delivery address is incomplete or unsupported outside our US and AU shipping zones
  • The product information or price contains an obvious error
  • The requested personalisation cannot be completed
  • The order breaches these Terms

If we cancel an order after payment has been received, we will refund the applicable amount to the original payment method. We will not cancel an order arbitrarily after accepting payment and beginning fulfilment.

9. Order Limits and Resale 

Products offered through this website are intended primarily for personal and household use. We may limit quantities where reasonably necessary to prevent fraud, unauthorised resale, inventory abuse or misuse of promotions. If you wish to place a wholesale or high-volume order, please contact us before purchasing.

10. Payments 

Payment must be completed using one of the methods available at checkout (including Visa, Mastercard, AMEX, PayPal, Shop Pay, Apple Pay, Google Pay, Afterpay, or Klarna). By submitting payment information, you confirm that:

  • You are authorised to use the selected payment method
  • The information provided is accurate
  • You authorise the applicable charge for your order

Payments may be processed by Shopify Payments or another third-party payment provider. We do not directly control the processing times or security procedures of those providers. Please refer to our Payment Method Policy for further information.

11. Order Changes and Cancellations 

You may request an order cancellation within 12 hours of placing the order. A 10% processing and management fee will be deducted from all customer-requested cancellations to cover administrative and payment gateway costs. After 12 hours, the order enters production or fulfilment and cannot be changed or cancelled. Orders cannot be cancelled after dispatch. Full conditions are provided in our Cancellation Policy.

12. Production and Shipping

  • Processing & Production: Most orders require 1–3 business days for production and processing.
  • United States (US): Estimated transit time is 2–4 business days (Total estimated delivery: 3–7 business days).
  • Australia (AU): Estimated transit time is 7–11 business days (Total estimated delivery: 8–11 business days).
  • Shipping Coverage: Shipping is currently available to physical addresses within the United States (US) and Australia (AU) only.
  • Rates & Thresholds: Standard tracked shipping costs $4.99 USD, and standard shipping is free for eligible orders over $120.00 USD after discounts.

Delivery dates are estimates rather than guarantees. Delays may occur due to carrier disruptions, public holidays, severe weather, regional delivery conditions, customs processing, or other circumstances outside our reasonable control. Please refer to our Shipping Policy for complete information.

13. Delivery Information 

Customers are responsible for providing a complete and accurate delivery address. If you notice an address error, contact us immediately. Address changes cannot be guaranteed after production or fulfilment has started. We are not responsible for delays resulting from incorrect or incomplete information provided by the customer. Where a parcel must be resent because of an incorrect address, refusal or failure to collect, reasonable additional shipping charges may apply. This does not limit our responsibility where the delivery problem was caused by us or our delivery provider.

14. Returns and Refunds 

We do not accept change-of-mind returns for personalised or custom-made products once production has started. For eligible non-personalised items, returns are accepted within 30 days of delivery. A 10% restocking fee applies to standard customer-initiated returns, and customers are responsible for return shipping costs unless the return is due to our error or a damaged/defective product. Original shipping fees are non-refundable. Approved refunds will be returned to the original payment method. Full details and guidelines are outlined in our Return & Refund Policy.

15. Applicable Laws and Rights 

These Terms shall be interpreted in accordance with applicable governing laws. Nothing in these Terms excludes, restricts, or modifies any consumer rights, statutory guarantees, or remedies available under applicable state, federal, or national consumer laws in the United States or Australia that cannot be lawfully excluded.

16. Reviews, Images and Customer Content 

If you submit a review, photograph, video, comment or other content to us, you confirm that:

  • You created it or have permission to share it
  • It does not infringe another person’s rights
  • It is not unlawful, misleading, defamatory or harmful
  • You have permission to share images of any identifiable person, including a child

You retain ownership of your content. If you tag Fablebabe on social media, we will request permission before using identifiable customer content in our marketing unless the platform’s functionality clearly provides otherwise. Where you expressly grant permission, you give us a non-exclusive, worldwide, royalty-free licence to reproduce and display the approved content for marketing and promotional purposes. You may withdraw permission for future use by contacting us, although previously published or printed material may not always be immediately retractable. We may remove customer content that breaches these Terms.

17. Intellectual Property 

All website content, including our brand name, logo, product photography, graphics, text, layout and original designs, is owned by or licensed to Fablebabe and is protected by applicable intellectual property laws. You may access the website for personal, non-commercial use. You must not copy, reproduce, modify, distribute, sell, republish or commercially exploit our content without prior written permission.

We do not exclude liability where doing so would be unlawful, including liability arising under applicable consumer protection laws. Our responsibility for faulty products, delivery problems and other order issues remains subject to all mandatory consumer rights and remedies.

23. Indemnity 

To the extent permitted by law, you agree to be responsible for loss reasonably suffered by Fablebabe as a direct result of your unlawful use of the website, infringement of another person’s rights or material breach of these Terms. This section does not require you to compensate us for loss caused by our own conduct, negligence or breach of law.

24. Privacy 

Your submission of personal information through the website is governed by our Privacy Policy. By using the website, you acknowledge that information may be processed by service providers located in the United States, Australia, or other international locations, as explained in that policy.

25. Changes to These Terms

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

27. No Waiver 

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without giving effect to any principles of conflicts of law, while respecting non-excludable consumer protections provided under applicable laws of your country of residence.
